Telangana Gram Panchayat : High Court: No Stay on Gram Panchayat Elections in Telangana
Hyderabad News: The Telangana High Court has made significant observations regarding the ongoing efforts to halt Gram Panchayat elections in the state. A petition was recently filed challenging reservations under G.O. No. 46, claiming that sub-categories (A, B, C, D) must be implemented to ensure fair distribution of reservations.
Court Rejects Stay Request on Elections
The High Court heard the petition on Friday and ruled that the election process cannot be stayed at this stage. The bench questioned whether the petitioner was seeking cancellation of elections merely due to the lack of sub-category reservations. It also clarified that earlier methods of reservation could continue for now.
EC Requests Non-Interference
When the petitioner’s counsel referred to a similar incident in 2009 involving GHMC, where elections were halted, the Election Commission lawyer intervened, stating that courts should not interfere after the election notification is issued.
Responding to this, the court said:
“We have not ordered the conduct of elections. How can we grant a stay at this stage?”
The court reiterated that no interference is possible in the ongoing election process.
Government Directed to Respond
The petitioner requested access to the Dedicated Commission report on reservations. However, the court stated that no such orders could be passed immediately. Instead, the High Court has directed the Telangana government to submit a counter-affidavit on sub-category reservations within six weeks.
The matter has now been adjourned for eight weeks, with the election process continuing as planned.
